Timescale, Inc. ("Timescale", "we", or "us") provides database software, managed cloud services, and other software and services (the "Services"). This Privacy Policy explains our online and offline personal information practices, the kinds of personal information we may collect, how we intend to use and share that personal information, and how you can exercise your privacy rights.

1. Scope

This privacy policy governs our processing of personal information via our website located at (the “Site”), our Services, and any other Timescale websites, products, or services that link to this Privacy Policy. To make this Privacy Policy easier to read, our Site, Services, websites, and other products and services are collectively called “Services.” This Privacy Policy is intended to meet requirements globally, including those in North America, Europe, APAC, and other jurisdictions. By using our Services, you consent to the collection, use, and disclosure of personal information in accordance with this Privacy Policy.An Important Note: This Privacy Policy does not apply to any of the personal information that our customers may collect and process using the Timescale Services ("Customer Data"). Our customers are controllers of the Customer Data and their respective privacy policies govern their collection and use of Customer Data. We act as a processor for our customers’ Customer Data and our processing of Customer Data is governed by the contracts that we have in place with our customers, not this Privacy Policy. Any questions or requests relating to Customer Data should be directed to our customers.

2. Personal Information We Collect And How We Use It

The types of personal information we collect (directly from you or from third parties) and our privacy practices depend on the nature of the relationship you have with us, our Services, and the requirements of applicable law.We collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources such as third-party services and organizations. Below are the ways we collect personal information and how we use it.
2.1. Types of Personal Information We Collect. Timescale collects Personal Information regarding its current, prospective, and former customers and users (collectively "Individuals").
A. Information You Provide Directly to Us. When you use the Services or engage in certain activities, such as registering for an account, responding to surveys, requesting Services or information, or contacting us directly, we may ask you to provide some or all of the following types of information:
  • Account Creation. We may collect information when you create an account with us, such as your name, your company name, email address, photograph, or avatar.
  • Paid Subscriptions and Other Transactions. We may collect personal information and details associated with your subscriptions to our Services and other transactions, including payment information, such as a credit card number or bank account numbers. Credit card payments made via our Services are processed by third-party payment processors (e.g., Stripe). We do not directly collect or store any credit card information entered through our Services, but we may receive information associated with your credit card information (e.g., your billing details). We and our third-party service providers (e.g., Shopify) may also receive your shipping address if you purchase goods via our webstore.
Communications with Us. We may collect personal information from you such as name, job title, company, phone number, email address, or mailing address when you choose to request information about our Services, register for our newsletter, community forum or blog, request to receive customer or technical support, or otherwise communicate with us.
Surveys. From time to time, we may contact you to participate in online surveys. If you do decide to participate, you may be asked to provide certain information which may include personal information. All information collected from your participation in our surveys is provided by you voluntarily. We may use such information to improve our Services and in any manner consistent with the policies provided herein.
Interactive Features. The social media sites we use may contain interactive functionality that allow you to engage with other users such as our LinkedIn, YouTube, Twitch, or Facebook pages; through Twitter, Slack, and GitHub; or on other social media sites. You may post content or comments to our community workspaces and forums, blogs, and other social media sites (the "User Materials"), participate in surveys, and otherwise interact with the Services and with other users. If you use any interactive functionality that requests or permits you to provide personal information, we and other third parties may collect the personal information that you provide in the course of using these interactive features. If you choose to submit content to any public area of the Services, such content will be considered “public” and will not be subject to the privacy protections set forth herein.
Sweepstakes or Contests. We may collect personal information you provide for any sweepstakes or contests that we offer. In some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.
Conferences, Trade Shows, and Other Events. We may collect personal information from individuals when we attend or host conferences, trade shows, and other events.
Business Development and Strategic Partnerships. We may collect personal information from individuals and third parties to assess and pursue potential business opportunities.
B. Information Collected Automatically. We may collect personal information automatically when you use our Services:
  • Automatic Data Collection. We may collect certain information automatically through our software or Services or through other methods of web or software analysis, such as your Internet protocol (IP) address, cookie identifiers, unique Service identifier, and other device identifiers that are automatically assigned to your computer or device when you access the Internet, hardware type and configuration, operating system, software version, data and usage information about the software or Services, Internet service provider, browser type and language, pages that you visit before and after using the Services, the date and time of your visit, the amount of time you spend on each page, information about the links you click and pages you view within the Services, and other actions taken through use of the software or Services such as preferences.
  • Crash Reports. If you send them, we may also receive crash reports with more detailed diagnostic information about your device and the activities that led to the crash.
  • Cookies, Pixel Tags/Web Beacons, and Cookie Technologies. We, as well as third parties that provide content or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies ("Cookie Technologies") to automatically collect information through the Services. We use Cookie Technologies that allow us to record certain pieces of information whenever you visit or interact with our Services, messaging, and tools.
Our uses of such Cookie Technologies fall into the following general categories:
  • Operationally Necessary. We may use first-party or third-party Cookie Technologies that are necessary for the operation of our Services. This includes Cookie Technologies that allow you access to our Services and that are required to identify irregular website behavior, prevent fraudulent activity and improve security, or that allow you to make use of our functions;

  • Analytics. We may use analytics services to collect information regarding visitor behavior and visitor demographics on some of our Services, and to develop Site content. Some of our analytics partners include:
  • Social Media Features, Forums, Blogs and Widgets. Our Services may include social media features such as the LinkedIn, Twitter, Twitch, and YouTube buttons, community Slack workspaces, community forums, or blog features. These social media features may collect your IP address, which page you are visiting on our Services, and may set cookies to enable the social media features to function properly. These social media features are either hosted by a third-party or hosted directly on our Services. Your interactions with these social media features are governed by the privacy policy of the company providing it.
  • Information from Other Sources. We may receive information about you from other sources, including through third-party services and organizations to supplement information provided by you. This supplemental information allows us to verify information that you have provided to us and to enhance our ability to provide you with information about our business and Services. For example, if you access our Services through a third-party application, such as a third-party login service or a social networking site, we may collect information about you from that third-party application that you have made available via your privacy settings.
2.2 How Timescale Uses Your Information.. We acquire, hold, use, and process personal information about Individuals for a variety of business purposes, including:
A. To Provide our Services. Timescale may use information about you to fulfill our contractual obligations with you and provide you with our Services including to:
  • Generally manage your information and accounts;
  • Respond to questions, comments, and other requests;
  • Provide access to certain areas, functionalities, and features of our Services;
  • Contact you to answer requests for customer support or technical support;
  • Allow you to register for events.
  • Communicate with you about your account, activities on our Services and policy changes; and
  • Process your financial information and other payment methods for Services purchased.
B. Administrative Purposes. We may use personal information about you for administrative purposes in our legitimate interest, including to:
  • Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, and prosecute those responsible for such activity;
  • Measure interest and engagement in our Services;
  • Improve, upgrade, or enhance our Services;
  • Develop new products and Services;
  • Ensure internal quality control and safety;
  • Verify Individual identity;
  • Debug to identify and repair errors with our Services;

  • Communicate about Individual accounts and activities on our Services and systems, and, in our discretion, changes to any Timescale policy;
  • Send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer support, or system maintenance;
  • Process payment for Services purchased;
  • Process applications and transactions;
  • Prevent potentially prohibited or illegal activities;
  • Verify your country of location to comply with any legal obligations;
  • Comply with our legal obligations; or
  • Enforce our policies and terms.
C. Marketing and Advertising Our Products and Services. Timescale may use personal information to provide you with materials about offers, products, and services that may be of interest to you, including new content, advertisements, or Services. We may provide you with these materials or advertisements by social media or email, via “interest-based” or “personalized advertising,”, as permitted by applicable law. You may opt out of the use of your personal information for marketing purposes.
D. Research and Development. Timescale may use personal information to create non-identifiable information that we may use alone or in the aggregate with information obtained from other sources, in order to help us to optimally deliver our existing Services or develop new Services. From time to time, Timescale may perform research (online and offline) via surveys. We may engage third parties to conduct such surveys on our behalf. All survey responses are voluntary, and the information collected will be used for research and reporting purposes to help us better serve Individuals by learning more about their needs and the quality of the Services we provide. The survey responses may be utilized to determine the effectiveness of our Services, various types of communications, advertising campaigns, and/or promotional activities. If an Individual participates in a survey, the information given will be used along with that of other study participants. We may share anonymous Individual and aggregate data for research and analysis purposes.
E. Direct Mail, Email, and Outbound Telemarketing. Individuals who provide us with personal information, or whose personal information we obtain from third parties, may receive periodic emails, newsletters, or other communications from us with information on Timescale’s Services or our business partners’ products and services or upcoming special offers/events we believe may be of interest. We offer the option to decline these communications at no cost to the Individual by contacting us as set forth in “Contact Us” below.
F. Anonymous and Aggregated Information Use. Timescale may use personal information and other information about you to create anonymized and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our Services, or other analyses we create. Anonymized and aggregated information is used for a variety of functions, including the measurement of visitors’ interest in and use of various portions or features of the Services. Anonymized or aggregated information is not personal information, and we may use such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes. We may share this information within Timescale and with third parties for our or their purposes in an anonymized or aggregated form that is designed to prevent anyone from identifying you.
G. Other Uses. Timescale may use personal information for which we have a legitimate interest, such as direct marketing, individual or market research, anti-fraud protection, or any other purpose disclosed to you at the time you provide personal information or with your consent.
2.3 Third-Party Websites, Social Media Platforms, and APIs/SDKs..
Third-Party Websites. The Services may contain links to other websites and other websites may reference or link to our Services. These other domains and websites are not controlled by us, and we do not endorse or make any representations about third-party websites or social media platforms. We encourage our users to read the privacy policies of each and every website and application with which they interact. We do not endorse, screen, or approve, and we are not responsible for the privacy practices or content of such other websites or applications.
Social Media Platforms. Our Services may include publicly accessible blogs, community forums, or messaging features. The Services may also contain links and interactive features with various social media platforms. If you already use these platforms, their cookies may be set on your device when using our Services. You should be aware that personal information which you voluntarily include and transmit online in a publicly accessible blog, chat room, social media platform, or otherwise online, or that you share in an open forum may be viewed and used by others without any restrictions. We are unable to control such uses of your information when interacting with a social media platform, and by using such third parties you assume the risk that the personal information provided by you may be viewed and used by third parties for any number of purposes.
API/SDKs. We may use third-party Application Program Interfaces (“APIs”) and Software Development Kits (“SDKs”) as part of the functionality of our Services. For more information about our use of APIs and SDKs, please contact us as set forth in “Contact Us” below.

3. How Timescale May Disclose Your Information

We may disclose your information as described in this Privacy Policy for a variety of business purposes, including with our third-party service providers to provide our Services, to comply with legal obligations, to protect and defend our rights and property, in the event of a major business transaction such as a merger, sale or asset transfer, as described below, or with your permission.
3.1 Disclosures to Provide our Services. The categories of third parties with whom we may share your information are described below.
  • Service Providers. We may share any information we receive with vendors and service providers who use that information to help us provide our Services. The types of service providers (processors) to whom we entrust personal information include service providers for: (i) provision of IT and related services; (ii) provision of information and Services you have requested; (iii) payment processing; and (iv) customer service activities.
  • Business Partners. We may share personal information with our business partners to provide you with a product or service that you have requested. Timescale may allow third-party advertising partners to set tracking tools (e.g., cookies) to collect information regarding your activities (e.g., your IP address, page(s) visited, time of day) on our Services. We may also share such de-identified information as well as selected personal information (such as demographic information and past purchase history) we have collected with third-party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit non-Timescale related websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising.” We may allow access to other data collected by the Services to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. If you prefer that we do not share your personal information with third-party advertising partners, you may opt out of such sharing at no cost by following the instructions described below under “Your Privacy Choices and Rights”.
3.2. Disclosures to Protect Us or Others (e.g., as Required by Law and Similar Disclosures).. We may access, preserve, and disclose your personal information, other account information, and content if we believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) protect your, our, or others’ rights, property, or safety; (iv) enforce our policies or contracts; (v) collect amounts owed to us; (vi) prevent physical harm or financial loss; (vii) assist in connection with an investigation or prosecution of suspected or actual illegal activity; or (viii) disclose your personal information in good faith where it is otherwise necessary or advisable under applicable laws.
3.3. Disclosure in the Event of Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. In such event, we will endeavor to direct the transferee to use Personal Information in a manner that is consistent with the Privacy Policy in effect at the time such Personal Information was collected.

4. International Data Transfers

You agree that all personal information collected via or by Timescale may be transferred, processed, and stored anywhere in the world, including but not limited to the United States, the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers. These countries may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws, but your personal information may be accessible to law enforcement or other authorities pursuant to a lawful request. By providing information to Timescale, you explicitly consent to the storage of your personal information in these locations.

5. Your Privacy Choices And Rights

5.1 Your Privacy Choices. The privacy choices you may have about your personal information are determined by applicable law and are described below.
A. Email and Telephone Communications. If you receive an unwanted marketing email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. We will process your request within a reasonable time after receipt. We may also send you certain non-promotional or transaction-related communications regarding Timescale and our Services, and you will not be able to opt out of those communications.
B. “Do Not Track”. Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
C. Cookies and Interest-Based Advertising”. You may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. Please note that cookie-based opt-outs are not effective on mobile applications. However, on many mobile devices, application users may opt out of certain mobile ads via their device settings. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes. Even if you opt out, we may still collect and use information regarding your activities on our Services and/or information from the advertisements on third-party websites for non-interest based advertising purposes, such as to determine how to optimize our Services.
5.2 Your Privacy Choices. In accordance with applicable law, you may have the right to:
  • Access Personal Information. about you, including: (i) confirming whether we are processing your personal information; (ii) obtaining access to or a copy of your personal information in a structured, commonly used, and machine readable format; and (iii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine readable format (the “right of data portability”);
  • Request Correction. of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information;
  • Request Deletion. Request Deletion of your personal information;
  • Request Restriction of or Object. Request Restriction of or Object to our processing of your personal information including where the processing of your personal information is based on our legitimate interest or for direct marketing purposes; and
  • Withdraw your Consent. Withdraw your Consent to our processing of your personal information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.
Although we make a good faith efforts to provide you with access to your personal information, there may be circumstances in which we are unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question or where it is commercially proprietary. If we determine that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, we will take commercially reasonable steps to verify your identity before granting access to or making any changes to your personal information.

6. Retention Of Personal Information

Timescale retains the personal information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

7. Security Of Your Information

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unintentional disclosure.By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Site or sending an e-mail to you. You may have a legal right to receive this notice in writing.

8. International Users

By using the Services, Timescale will transfer data to the United States and other global jurisdictions. By choosing to visit the Site, utilize the Services or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of New York, United States and the adjudication of any disputes arising in connection with Timescale or the Services will be in accordance with the Terms.If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to processing of your data globally. By providing your personal Information, you consent to any transfer and processing in accordance with this Policy.

9. Children’s Information

The Services are not directed to children under 13 years of age (or other age as required by local law), and Timescale does not knowingly collect personal information from children under 13 years of age (or other age as required by local law). If you are a parent or guardian and learn that your child has uploaded personal information to our Services without your consent, you may alert us as described in “Contact Us” below. If we learn that a child has provided us with personal information in violation of applicable law, we will promptly take steps to delete such information, unless with have a legal obligation to keep it.

10. Other Provisions

10.1 Supervisory Authority. If you have any questions about our privacy practices, this Privacy Policy, or how to lodge a complaint with the appropriate authority, please contact us as described in “Contact Us” below. We will address your concerns and attempt to resolve any privacy issues in a timely manner.
10.2 Changes to our Privacy Policy. We may revise this Privacy Policy from time to time in our sole discretion. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use our Services after the new Privacy Policy takes effect.
10.3 New Uses of Personal Information. Additionally, before we use personal information for any new purpose not originally authorized by you, we will endeavor to provide information regarding the new purpose and give you the opportunity to opt out. Where your consent for the processing of personal information is otherwise required by law or contract, we will endeavor to comply with the law or contract.

This Supplemental Notice for California Residents only applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA provides California residents with the right to know what categories of personal information Timescale has collected about them, and whether Timescale disclosed that personal information for a business purpose (e.g., to a service provider) in the preceding 12 months. “Sales” of Personal Information under the CCPA. For purposes of the CCPA, Timescale does not “sell” personal information, nor do we have actual knowledge of any “sale” of personal information of minors under 16 years of age, as the term “sell” is commonly understood. That said, we do share personal information with certain third-party advertisers for retargeting purposes, which may be considered a “sale” under the CCPA. To the extent that such sharing is considered a “sale” under the CCPA, you may opt-out of having your information shared by disabling third-party cookies on your device, or by contacting us as set forth in “Contact Us” below.
Additional Privacy Rights for California Residents.
Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.
Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us as set forth in “Contact Us” below and provide written authorization signed by you and your designated agent.
Verification. To protect your privacy, we will take the following steps to verify your identity before fulfilling your request. When you make a request, we will ask you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include asking you to answer questions regarding your account and use of our Services.If you are a California resident and would like to exercise any of your rights under the CCPA, please contact us as set forth in “Contact Us” below. We will process such requests in accordance with applicable laws.
Accessibility. This Privacy Policy uses industry-standard technologies and was developed in line with the World Wide Web Consortium’s Web Content Accessibility Guidelines, version 2.1. If you wish to print this policy, please do so from your web browser or by saving the page as a PDF.
California Shine the Light. The California “Shine the Light” law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. Except as otherwise provided in this Privacy Policy, Timescale does not share personal information with third parties for their own marketing purposes.
